2nd of 4 home invaders sentenced for killing of Burnaby, B.C., 19-year-old

The second of four people to plead guilty to manslaughter in the 2023 killing of 19-year-old Burnaby, B.C., man Ryan Nagy was sentenced Thursday.

Rais Muksal Usman was sentenced to six years of incarceration for his role in the violent home invasion that led to Nagy’s death, though after credit for time served, he will spend a little more than half that time behind bars.

Usman was one of four people who broke into the Nagy family home on Jun 29, 2023. Their plan was to steal firearms owned by Nagy’s father and stored in a safe in the basement.

They intended to threaten Nagy and convince him to open the safe, according to B.C. Supreme Court Justice Andrew Majawa’s sentencing decision, which was published online Friday.

“The intruders arrived together at the Nagy residence,” the decision reads. “They all wore dark clothes and balaclavas. They brought knives, duct tape and zip ties with them. Mr. Usman himself was carrying a knife, and he knew that others were variously carrying knives, duct tape, and zip ties.”

According to the decision, the other three intruders entered Nagy’s bedroom, where he and his girlfriend were asleep. Usman entered the house but did not go into the bedroom.

A struggle ensued, during which Nagy was fatally stabbed by one of the other intruders. He and his girlfriend were bound with duct tape and brought down to the basement, but Nagy was unconscious by the time they arrived outside the gun safe, the decision notes.

Around 7 a.m., just 30 minutes after the home invasion began, Nagy’s father returned home “unexpectedly,” according to the decision. He encountered Usman and another of the intruders at the bottom of the stairs leading to the basement and confronted them, grabbing Usman, who broke free and fled, leaving his knife, sunglasses and balaclava behind.

All four intruders fled the scene. They were arrested and charged more than a year later, in September 2024.

Usman is the second of the four to be sentenced. Ali Shamkhi pleaded guilty to manslaughter and weapons offences in October 2025 and was sentenced to a total of 10.5 years late last month.

The other two home invaders, Ousmane Keita and Rhoda Mboka Diabikulu, have also pleaded guilty to manslaughter. Their sentencing hearings are scheduled to be held on June 10 and 11, respectively.

22 victim impact statements

The judge in Shamkhi’s sentencing described Nagy’s death as an “incalculable” loss to those who knew and loved him.

Majawa’s decision echoed that sentiment, noting that 22 victim impact statements were received in the case.

“Many of these were read by the authors in court or by others on their behalf,” the decision reads. “I’ve listened carefully to each of these and also read them carefully in my chambers. I am struck by common themes running throughout the statements with respect to Ryan Nagy’s character—loyalty, kindness, generosity, respect, and talent.”

“I am also struck by a common theme with respect to the impact of Ryan Nagy’s death on these family members and friends,” it continues. “His death has had a profound, lasting, and devastating impact on each of them. In addition to the deep feelings of loss, sadness, and anger, many of them speak of seeing the world in a different way than they did before, of feeling less safe, of having lost trust, and experiencing confusion.”

Offender’s background

Usman’s sentence was the result of a joint submission by Crown and defence lawyers. In such circumstances, trial judges are required to accept the submission unless it “would bring the administration of justice into disrepute or is otherwise contrary to the public interest,” according to Majawa’s decision.

The judge concluded that was not the case with this joint submission.

Majawa considered a variety of aggravating and mitigating factors when determining the acceptability of the proposal.

“Although Mr. Usman did not enter the bedroom where the attack took place, Mr. Usman was a party to what can accurately be described as a cowardly, premeditated assault on two persons who were sleeping when he and the other intruders entered the Nagy house that morning,” the decision reads, introducing the aggravating factors.

The use of the knife, the fact that the crime took place in Nagy’s home and the fact that Usman and his co-accused fled the scene rather than trying to help Nagy get treatment for his injuries were all considered aggravating, according to the decision.

Mitigating factors included Usman’s youth—he was 19 at the time of the offence and is 22 today—and lack of a criminal record.

He was also the first of the four accused to enter a guilty plea, the decision notes.

According to the document, Usman and his family came to Canada from Indonesia as refugees when Usman was a young child.

“It appears that he faced many of the struggles that are typical to racialized individuals who come to Canada as refugees including challenges with housing, poverty, employment, racism, and cultural dislocation,” the decision reads.

“This of course did not directly cause, nor does it explain or excuse Mr. Usman’s offending in any way. Rather … in part, (it) speaks to the way in which these experiences may have increased his risk of him being involved in criminal behaviour.”

Usman read a letter in court expressing remorse and apologizing for his role in the killing, according to the decision.

In addition to imposing the six-year sentence, Majawa ordered Usman to submit a DNA sample and banned him from possessing weapons and from communicating with members of Nagy’s family.
