Here’s what police can and can’t do regarding public drug use: WPS

Windsor police are outlining what police can and can’t do regarding public drug use after the community has raised concerns about the issue and the impact it has in local neighbourhoods.

Police say many people ask why arrests aren’t being made in these situations.

Here’s why:

• While simple drug possession or public drug use can meet the threshold for arrest, police say a significant portion of these charges are ultimately withdrawn based on current legal and court practices.
• Over the past five years, officers have laid over 500 criminal charges for incidents of drug possession. However, 85 per cent of these charges were later withdrawn or dismissed by the courts, and only 6 per cent resulted in convictions. These cases tied up considerable police resources, often without delivering a meaningful public safety outcome.
• Police say evidence has shown that enforcement alone has limited effectiveness in changing this behaviour. That’s why they say they remain focused on a compassionate approach that supports well-being for all members of the community.
• The Nurse Police Team and Crisis Response Team pair officers with nurses and social workers to provide on-scene care in crisis scenarios, steer individuals away from the emergency department and criminal justice system, and connect them with community resources for ongoing support.
• Police say they are also using available provincial legislation, including the Restricting Public Consumption of Illegal Substances Act, to guide enforcement and set clear expectations around public spaces. This can include directing individuals to leave and issuing a court summons, while still using discretion and connecting people to supports where possible.
• At the same time, the Drugs and Guns Enforcement Unit (DIGS) is working to take drugs off the streets and disrupt production and trafficking networks. In 2025, this unit seized more than 3,000 grams of crystal meth, 3,500 grams of oxycodone, and 4,000 grams of fentanyl.

“We stand in lockstep with Mayor Drew Dilkens and Windsor City Council on this complex issue. We are working together, through the means available to us, to create safer, more vibrant and welcoming streets and neighbourhoods for everyone to enjoy,” according to a police social media post.
