London might consider tenant protections against demolition and redevelopment - in 2027

As city council continues to support intensification, city leaders are looking for innovative ways to support tenants when housing is slated for replacement.

A motion by Coun. Skylar Franke could lead to greater protections for tenants in affordably-priced private market apartments when their landlord considers demolishing, converting, or redeveloping their building.

On Tuesday, the Planning and Environment Committee (PEC) was reminded that several recent rezoning applications for high-density development required non-binding agreements with developers to prevent existing tenants from being displaced.

Franke told the committee, “As we continue to see and support growth and intensification in the city, I believe we also have a responsibility to ensure that the people calling these places home are not left behind in this process.”

Provincial legislation sets a baseline requirements, but municipalities can strengthen local protections and set clearer expectations for landlords.

“There are other municipalities that have brought these extra protections,” said Coun. David Ferreira. “Whether it’s Mississauga, Oakville, Hamilton or Kitchener, these protections exist and they seem to be allowed under the Municipal Act.”

Members of PEC recommended having city staff report back on the feasibility of establishing a Tenant Assistance and Relocation Program for the City of London by the end of March, 2027.

The report would consider potential components of the program including:

• minimum notice periods
• financial compensation
• rent gap payments
• right-of return provisions
• rental replacement requirements
• and relocation support services.

In addition, it will consider the financial, legal, and administrative implications, as well as recommend potential implementation options.

It could require updating local policies, zoning, site plan control, or other municipal tools.

Coun. Corrine Rahman expressed concern about tenants who may be impacted in the interim period before protections can be put in place.

However, the committee acknowledged that planning staff already have a significant workload this year.

Council will make a final decision about requesting the report on April 28.

Franke concluded, “As we’re trying to build the London of tomorrow, we must make sure that the tenants and residents of London are not having their housing destabilized.”
